In everyday business, Motus Melior enters into a large number of relationships, both with the customers and with its own employees. For that reason, it is necessary to separate precisely to which relationships, i.e. types of interaction, this Policy applies.

In that sense, this Policy is applied solely in the following cases:

  • If you visit our website;
  • If you are applying for a job with Motus Melior;
  • If you subscribed to our Newsletter;
  • If you are addressing our Contact Center using the online form;

Who is processing your personal data?

With regard to the processing of personal data mentioned in this Policy, the company Motus Melior d.o.o., with a registered seat in Zagreb, Hektorovićeva 2, PIN/OIB 41345472577 is a data controller in a sense of the REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of April 27, 2016 ("GDPR").

What data do we collect and what do we do with them?

During the interaction with you, we will be processing various personal data. The processing will depend both on the type of interaction we have with you, and on the type of service we provide for you.

Transfer of your personal data

Depending on the type of your interaction with Motus Melior, we will exceptionally exchange certain personal data with the third parties. We thereby guarantee you that the goal of the exchange is not exploitation of your personal data, but it is to exchange the same for the purpose of providing the quality and timely service and compliance with the legal and regulatory obligations.

Following the stated, Motus Melior, depending on a situation, will potentially exchange personal data with the following categories of persons:

  • Third persons and bodies governed by public law, namely (i) in order to be in compliance with the legal or regulatory rules, (ii) in order to act based on a mandatory instruction or an order by a body governed by public law, (iii) in order to prevent and/or report misuse and unlawful activities, (iv) in order to protect the rights and personal safety of our employees and the third parties, and (v) in order to protect ourselves from lawsuits and other claims by the third parties.
  • All other persons, with regard to which we have received your express consent for the exchange.

Exceptionally, in case of the status changes of the company Motus Melior (e.g. acquisition, merger, separation, etc.), your personal data may be transferred to a different legal person.

Your data and the third countries

Your personal data will be processed and transferred solely within the territory of the European Union. Personal data will not be transferred to business entities or other persons in the countries outside the European Union.

How long do we store your data?

Period of storing your personal data will depend primarily on the purpose for which the same were collected. In that sense, we guarantee you that we will not store your data longer than the same is absolutely necessary for the fulfillment of purpose for which they were collected.

Independent of the stated, in certain cases we will be legally bound to store certain data for a longer period than absolutely necessary for the fulfillment of purpose of the processing. In that case, we will store personal data only within the legally prescribed minimum. For example, records and documents on daily cash transactions, business books and bookkeeping documents and other records must be stored for a minimum of 10 years.

In conclusion, we also inform you that, with fulfillment of the GDPR prescribed requirements, you have the right to request deletion of your personal data in possession of Motus Melior. The instructions on the manner of exercising your right are presented in detail in the section "Your rights".


Motus Melior is fully aware that the children are an especially sensitive group, and therefore it pays a special attention to the protection of their personal data.

In that sense, Motus Melior is harmonized with the provisions of the Croatian law pertaining to the minimum age limit for entering legal transactions, including personal data processing. Among other things, we will ask for the express consent of the child’s parent for the provision of certain services, i.e. access to the certain sections of our website.

Your rights

For the purpose of an effective control over processing of your personal data, you have at your disposal a large number of rights which, in cases prescribed by the law, you can exercise directly against Motus Melior.

This includes the following rights:

  • The right to request information whether Motus Melior is processing your data, and if that is the case, to request detailed information regarding the concrete processing;
  • The right to request access to your personal data, in a manner that Motus Melior makes a copy of the same, in a physical or digital form;
  • The right to request correction of your inaccurately or incompletely stated personal data we are in possession of;
  • The right to request that we delete your personal data we are in possession of;
  • The right to request that we limit processing of your personal data;
  • The right to request that we transfer your personal data we are in possession of to another data controller;
  • The right to state a complaint in relation to the processing of your personal data by Motus Melior, especially with regard to direct marketing based on a legitimate interest of Motus Melior and automated processing;
  • The right to withdraw consent for the processing of your personal data at any time, if the processing is based on consent;

In case you would like to activate any of the abovementioned rights (save for the last one), we kindly ask you to contact the competent person in our Contact Center, using information from the section "How to Contact Us?" Thereby we kindly ask you to have in mind that, for the purpose of the successful processing of your request, we will primarily have to establish your identity (e.g. by sending a copy of the Identity Card). The stated personal data will be used solely for the purpose of identification, and will be deleted immediately upon establishing the identity.

Exercising the abovementioned rights is completely free of charge. However, in case that your requests for exercising the rights are evidently unfounded or excessive, (e.g. due to the frequent repetition within a shorter period of time) we reserve the right, according to our own assessment, to (i) charge a reasonable fee for acting upon the request, or (ii) decline acting upon the request.

Changes in Privacy Policy

For the purpose of harmonizing with the GDPR requirements and other applicable regulations, this Privacy Policy has been updated and changed in October 2019.

Considering that it is likely that by the passage of time the existing processes in data processing will be changing and the new processes in data processing will likely be implemented, this Privacy Policy will need to be amended or supplemented. The amended or supplemented version of the Policy will be published on the Motus Melior website, immediately upon its adoption.

In case we make significant changes, we will inform you about the same clearly and in a timely manner, in order for you to be able to review the changes and independently decide whether you wish to continue using the services of Motus Melior. Depending on the type of personal data processing, the notification will be published on the Motus Melior website, or we will contact you directly (e.g. via email).
